Abstract

The customary law that applies in the Tobati Tribe also greatly influences the behavior of the community. The Tobati people live far from the corner of the city, they have to cross the river by boat to get to the city. Their understanding of marriage law is still minimal. Marriage in the meaning of "traditional engagement" is a marriage that has customs that apply in the community concerned, especially in the Tobati indigenous people. The causes of traditional marriages in the indigenous people of Kampung Tobati are: Marriage between a man and a woman, both of whom come from the Tobati indigenous people in Jayapura City, so that the marriage process can take place according to custom. Marriage between a man and a woman, where one of them comes from the Tobati indigenous people so that the marriage process can be carried out according to custom. Traditional marriages that are still being arranged by the Tobati village community have legal implications, because there are still couples who carry out their marriages that are not registered and recorded at civil registration institutions, consequently affecting population administration, not having a marriage certificate. The it can be said that the marriage is not recognized by the state so that the legal consequence is that children born from marriages that are not registered and registered do not have birth certificates.
